1. Acceptance of Terms

By accessing or using Jotlily ("we," "us," "our") website, mobile application, or services (collectively, the "Platform"), you ("you," "your," "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. About Jotlily

Jotlily is a peer support community focused on mental health and wellness. We provide a platform for individuals to connect, share experiences, and support one another through their mental health journeys.

2.1 What We Provide

  • Peer-to-peer support community forums
  • Mental health resources and educational content
  • Blog articles and wellness information
  • Community events and group discussions
  • Connection tools for peer support

2.2 What We Are NOT

  • We are NOT licensed mental health professionals
  • We do NOT provide therapy, counselling, or medical treatment
  • We are NOT a substitute for professional medical care
  • We do NOT diagnose or treat mental health conditions

3. User Eligibility and Registration

3.1 Age Requirement

  • You must be at least 18 years old to use our Platform
  • By using our services, you represent that you meet this age requirement

3.2 Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You may not share your account with others
  • You must notify us immediately of any unauthorised use of your account

3.3 Prohibited Users

We reserve the right to refuse service to anyone who:

  • Has been previously banned from our Platform
  • Violates our Community Guidelines
  • Misrepresents their identity or credentials
  • Uses our Platform for commercial purposes without authorisation

4. Community Guidelines and User Conduct

4.1 Acceptable Use

You agree to use our Platform only for lawful purposes and in accordance with these Terms and our Community Guidelines. You will:

  • Treat all community members with respect and kindness
  • Share experiences and support others in a constructive manner
  • Respect privacy and confidentiality of other members
  • Use appropriate content warnings when discussing sensitive topics
  • Report concerning behaviour through our reporting mechanisms

4.2 Prohibited Activities

You may NOT:

  • Harass, intimidate, threaten, or abuse other users
  • Share content that is illegal, harmful, or offensive
  • Provide medical advice or diagnose mental health conditions
  • Impersonate others or misrepresent your credentials
  • Share personal contact information publicly
  • Spam, advertise, or engage in commercial activities without permission
  • Attempt to harm our Platform's security or functionality
  • Encourage self-harm, suicide, or dangerous behaviours
  • Share graphic or disturbing content without appropriate warnings
  • Violate any applicable laws or regulations

4.3 Content Standards

All content shared on our Platform must:

  • Be respectful and supportive in nature
  • Include content warnings for potentially triggering material
  • Respect intellectual property rights
  • Comply with applicable privacy laws
  • Be factual and not misleading regarding mental health information

5. Mental Health Disclaimers and Limitations

5.1 NOT Professional Treatment

IMPORTANT: Jotlily provides peer support, NOT professional mental health treatment. Our Platform:

  • Does not replace therapy, counselling, or medical care
  • Is not supervised by licensed mental health professionals
  • Cannot provide crisis intervention or emergency services
  • Should not be used as the sole resource for mental health support

5.2 Peer Support Nature

  • All support provided is from peers with lived experience, not professionals
  • Peer supporters are not trained therapists or counsellors
  • Individual experiences and advice may not be suitable for everyone
  • You should consult qualified professionals for medical or therapeutic needs

5.3 Crisis Situations

If you are in immediate danger or having thoughts of self-harm:

  • Call emergency services (911 in the US)
  • Contact the National Suicide Prevention Lifeline: 988
  • Text "HELLO" to 741741 for Crisis Text Line
  • Go to your nearest emergency room

Our Platform is NOT equipped to handle mental health emergencies.

6. Privacy and Data Protection

6.1 Information Collection

We collect information as described in our Privacy Policy, including:

  • Account registration information
  • Content you share on our Platform
  • Communication with our support team
  • Usage data and analytics

6.2 Information Sharing

  • We do not share personal information with third parties except as outlined in our Privacy Policy

  • We strive to maintain Platform availability but cannot guarantee uninterrupted service
  • We may suspend service for maintenance, updates, or technical issues
  • We reserve the right to modify or discontinue features at any time

10.2 Updates to Terms

  • We may update these Terms periodically
  • Significant changes will be communicated through the Platform or email
  • Continued use after changes constitutes acceptance of updated Terms

11. Account Termination

11.1 Your Rights

  • You may delete your account at any time through your account settings
  • Account deletion will remove your access to community features
  • Some content may remain visible in community discussions

11.2 Our Rights

We may suspend or terminate accounts for:

  • Violation of these Terms or Community Guidelines

  • Extended period of inactivity

11.3 Effect of Termination

Upon termination:

12.2 Health and Safety Disclaimers

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOTLILY SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, punitive, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from use of our Platform or reliance on content
  • Actions or omissions of other users
  • Technical failures or security breaches

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT PAID FOR SERVICES, WHICHEVER IS LESS.

13. Indemnification

You agree to indemnify and hold harmless Jotlily, its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Content you post or share

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Finland, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration rather than court proceedings, except for:

  • Requests for injunctive relief
  • Small claims court matters

14.3 Class Action Waiver

You agree to resolve disputes individually and waive rights to participate in class action lawsuits.

15. General Provisions

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Jotlily.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 Assignment

We may assign these Terms to a successor entity. You may not assign your rights without our written consent.

15.4 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.
